What is checked before a Portugal Golden Visa is approved?

An ARI application combines Portuguese immigration requirements with a qualifying investment. AIMA's published rules cover the applicant's identity, legal entry and stay, criminal-record evidence, relevant Portuguese public-authority statements and proof of the investment. Portuguese banks and investment managers can separately require evidence of how the capital was earned and who owns it. An approved bank transfer does not guarantee a residence permit, and meeting immigration rules does not guarantee bank onboarding.

If you are committing €500,000 or considering a substantial cultural contribution, prepare two linked but separate evidence packs. One should serve the Portuguese immigration lawyer and AIMA; the other should explain source of funds, source of wealth, beneficial ownership and the exact banking trail to the qualifying Portuguese recipient.

The criminal-record documents identified by AIMA

AIMA describes criminal-record certificates issued in the applicant's country of origin or relevant countries of residence, alongside translation and certification requirements. The official ARI page also refers to a certificate issued within three months before the complete required documentation is submitted. The precise acceptable form, international authentication and timing should be checked for each jurisdiction by a Portuguese lawyer.

Portugal's general residence conditions can also involve certain serious criminal convictions, outstanding exclusions from entry and other refusal grounds. A person with a prior conviction, dismissed charge, sealed record or unusual immigration history should request a private, individualised assessment instead of trusting a generic online promise that their record will be disregarded.

Where spouses, dependent adult children or other relatives join the application, check the personal evidence and criminal-record requirements relevant to each person. A family's file may involve multiple nationalities, countries of prior residence and certificates with different validity periods.

Source of funds is different from source of wealth

Source of funds explains the immediate origin of the specific amount to be transferred to the fund or cultural recipient. Source of wealth explains the broader process through which the applicant accumulated assets. A statement showing €500,000 in a bank account can help document the transfer but may not sufficiently establish where the capital was originally earned.

An entrepreneur may have received dividends over twenty years, sold part of a business and reinvested earlier investment gains. The compliance file needs a coherent narrative, with each significant payment linked to corresponding documents. This protects legitimate applicants from ambiguity and gives banks a basis for their customer due diligence.

Evidence for business owners and company-sale proceeds

A business owner using sale proceeds can collect the sale agreement, ownership register or cap table, settlement statement, escrow evidence, corresponding tax documentation and bank credit entries. Where the buyer pays in several instalments, reconcile the actual cash amounts and dates. Deferred payments or shareholder loan repayments should be described accurately rather than bundled into an unexplained lump sum.

Where a holding company, family office or trust controls the capital, the question is not only whether the cash exists. Lawyers and banks need to identify the investor, the beneficial owners, the relevant legal rights and the permitted transaction structure. Do not assume that every corporate payment can be treated as the main applicant's personal investment.

Dividend, employment income and investment portfolio evidence

Accumulated savings from salary or bonuses may be supported by employment contracts, remuneration records, tax returns and time-series bank statements. For company dividends, corporate resolutions, ownership records and bank credits can help establish entitlement. An informal transfer between a founder and a company should not be described as a dividend without documents supporting that characterisation.

Capital released from listed securities or private investments may require custody statements, trade confirmations, broker account ownership, evidence of the original holdings and the final transfer to the account that will fund Portugal. Some assets can be liquidated quickly; others require several cross-border transactions that should be explained in a dated ledger.

Inheritance, gifts and multi-generational wealth

Inherited wealth can require a grant of probate or comparable succession authority, estate-distribution records, legal evidence of the relationship and the bank trail for the inherited proceeds. A family gift can involve a gift instrument, donor identity and evidence of the donor's lawful source of the capital. A relative's high net worth is not a substitute for the financial institution's actual documentation.

Family trusts, holding entities and fiduciary arrangements often have distinct beneficiaries, owners and signatories. Each participating entity should be identified, and the Portuguese counsel must verify whether the proposed holder or payment structure can satisfy the ARI route. Home-country tax consequences may be substantial and require separate expert review.

Can proceeds of a property sale finance a Golden Visa fund?

A legitimately owned property may be sold and its net proceeds used to fund a different qualifying Portuguese investment. Keep title and sale documents, settlement and mortgage repayment evidence, taxes and statements showing the payment sequence. However, buying a Portuguese property is no longer itself an eligible new Golden Visa investment; the qualifying fund or other route must be reviewed independently.

What does the Portuguese bank check?

Bank onboarding can involve identity, occupation, nationalities, residence, tax records, beneficial ownership and the overall economic explanation for the transfer. The institution may request additional material in high-value or cross-border cases. The level of detail and acceptable forms can vary among banks and fund custodians, so no single published checklist guarantees that an account will be opened.

Politically exposed persons and relevant associates can receive enhanced scrutiny in financial services. FATF guidance describes the use of risk-based customer due diligence, rather than assuming political exposure alone proves wrongdoing. It is better to explain relevant public roles and corporate connections transparently than to obscure them.

Make every transfer traceable before investing

Record each substantial transfer's date, amount, currency, sender, receiving institution, account owner, foreign-exchange intermediary and final beneficiary. Save original bank confirmations. Verify any change to the receiving account using a separate communication channel before sending funds. A social message or an amended invoice by itself is not sufficient authentication of a destination for a high-value transfer.

AIMA's official fund route has its own supporting evidence, including confirmation of the international transfer, ownership of fund units and relevant fund-manager declarations. Cultural contributions require their own recipient and cultural-administration evidence. Banks, lawyers and project operators should agree on the documentary sequence before the applicant commits capital.

Avoid the five preventable mistakes

First, ordering criminal records too early and losing their validity before filing. Second, submitting inconsistent personal or company names with no explanation. Third, transferring funds from an unexpected third party or business account without confirming legality. Fourth, failing to distinguish the bank's AML requirements from the documents formally required by AIMA. Fifth, sending an irreversible contribution or entering a fund commitment before the banking plan has been checked.

A single document register can reduce these failures. Give each item an owner, description, source jurisdiction, issue and expiration dates, translation and legalisation status, and the professional or institution that needs it. Keep the authentic original and record any later correction clearly.

Illustrative situations for wealthy families

A company founder after a liquidity event

A founder sells part of a business and receives proceeds via escrow. The relevant file links the original ownership, signed contract, actual settlement dates and banking trail. A parallel financial review examines whether committing €500,000 will harm working-capital flexibility.

A family office using cross-border holdings

The money is held by a company, but the individual wants Portuguese residence. The legal ownership, beneficial owners, payment pathway and correct subscriber must be examined together. Moving the capital first and asking compliance questions later may create avoidable risk.

An heir combining inheritance and investment gains

Funds arise from two distinct sources. Separate legal and financial documentation is maintained for each, then reconciled into the final bank account. Relevant home-country estate, tax and reporting questions should be addressed by qualified professionals.

Frequently asked questions about background checks

Do all Golden Visa applicants need police certificates?

AIMA publishes criminal-record requirements for applicants; family categories and individual circumstances require case-specific document review. Do not assume every certificate issued abroad will be accepted in the same form.

Can a gift or inheritance be used to make the investment?

Potentially, where the applicant lawfully owns the funds and can evidence the donor, estate, transfer and broader source of wealth as required. Neither route bypasses normal bank due diligence.

Does a successful bank compliance check guarantee an ARI card?

No. Banking acceptance, qualifying-investment evidence and AIMA's immigration decision are distinct processes.

Will several funds make the AML process easier?

Not necessarily. Multiple subscriptions can increase documentation and bank coordination, while the overall legality and origin of the investment money still need to be clear.

Sources, scope and next step
